Automobiles operated by Charles Otis and Ralph T. Cheeves were involved in a collision. Otis filed suit in the, municipal court ,of Atlanta, Eulton section (now civil court of *779Fulton County, and hereinafter referred to as such), against Knight Brothers Paper Company and Cheeves, seeking to recover damages for injury to his automobile. It was alleged that Cheeves was the agent of Knight Brothers Paper Company, and at the time of the collision was in the prosecution and within the scope of his duties as such agent.
