MEMORANDUM OPINION AND ORDER

WINGATE, District Judge.

Before the court is the defendant’s motion for summary judgment filed pursuant to Rules 56(b) and (c), Federal Rules of Civil Procedure. 1 Defendant here is Wal-Mart Stores, Inc., (Wal-Mart). The plaintiff is James Brady, a former employee of Wal-Mart.
