On September 10, 1921, being the last day of the April term of the circuit court. of St. Clair county, judgment was entered by confession in said court for $969.48, in favor of appellee and against appellant on a judgment note. On September 26, .1921, being one of the judicial days of the September term of said court, appellant presented a motion supported by affidavits to stay execution, vacate said judgment and for leave to plead to the merits.
