BROOKS, Judge.
This conviction was for murder in the second degree, with five years in the penitentiary fixed as the punishment.
Appellant, Tom Snowden, Winton Parnell and Ed Eancher were separately indicted for the murder of Wash Roberts. The evidence shows that deceased had been drinking some and went to the depot at Poyner, Henderson County, late in the afternoon of December 2, 1905, where he met Winton Parnell and Ed Eancher, both of whom were quite drunk.
