For brevity and convenience, the plaintiff in error will be referred to as defendant. On November 9, 1923, Paul McCarthy was shot and killed near the corner of Twentieth and Robinson streets, Oklahoma City. The shooting occurred at about 11:25 p. m. The de ceased, a lawyer, was called from his home by telephone just before the shooting. On the 27th day of December, following, the defendant made a sworn statement, in effect, charging Frank Brumley and Eustace Knight with the crime.
