If at the conclusion of the trial there was any question of fact to be submitted to . the jury, no complaint can justly be made of the manner of the submission and no assignment of error makes any such complaint. The able counsel for appellant sought a binding direction in his favor in the court below and thereafter urged upon that court and this court the entry of a judgment for the defendant notwithstanding the verdict.
