Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered May 23, 1975, convicting him of three counts of criminal sale of a controlled substance in the third degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, and new trial ordered. The facts have been considered and are determined to have been established. Defendant was tried on consolidated indictments charging him with three sales of heroin in February and March of 1974 to an undercover police officer.
