RUARK, Judge.

This is an appeal from a judgment on a jury verdict for the value of a cotton crop destroyed by a construction company while acting as agent for a drainage district in the building of a levee.

The petition alleges that at the beginning of 1952 plaintiff was a tenant of the owners of the land under an agreement to pay one-fourth crop rental. On January 12, 1952, the drainage district filed in the circuit court its petition to condemn a right of way over the land which plaintiff had rented.
