BEAMER, District Judge.
Defendants were charged along with four other persons in a four-count indictment with violations of 21 U.S.C. §§ 841(a)(1) and 846. 1 Count I charged Ernest Infeliee, Mario Garelli, Chester Garelli, Frank Sarris, Ernest Brown and James McGarry with conspiracy to distribute heroin and to possess heroin with intent to distribute in violation of § 841(a)(1). The remaining counts charged Infeliee, the two Garellis and Sarris with distributing 1.05 and 275.96 grams of heroin on April 14, 1972, and 293.3 grams of heroin on April 27, 1972.
