FINDINGS OF FACT AND CONCLUSIONS OF LAW

JORDAN, District Judge.

The court tried this civil action without a jury on September 23, 1996. Before the trial, the court considered and denied the defendants’ motion for summary judgment, and then treated the evidentiary material submitted in support of and in opposition to this motion for summary judgment as part of the record at trial. After the trial, the court allowed the parties some time within which to negotiate a settlement of the case, but the parties have been unable to agree.
