RESTANI, Judge:

Plaintiff, the United States of America, brings this action for penalties and forfeitures 1 alleging that defendants Gold Mountain Coffee, Ltd., Gold Mountain Holdings, Ltd., and Teck Hock and Company, Ltd. made false statements in connection with the importation of coffee beans labeled as originating in the Peoples’ Republic of China. Defendants counterclaim, inter alia, for damages alleging improper detention and seizure of the coffee beans. Plaintiff seeks partial summary judgment dismissing the counterclaims based on lack of jurisdiction and the doctrine…
