It is first contended that the court erred in admitting proof of an affray between Brom and a young man by the name of Kirby Merrit, which occurred in the kitchen of said restaurant a few minutes before Brom entered the lunch room and before the fight took place between Brom and Roberts, and at a time when neither Brom nor Roberts knew the other was in the building.
