Reversing.
This suit was brought by J. K. Hobbs, as administrator of Bert Morgan, against the Louisville & Nashville Railroad Company to recover damages for the death of Morgan, alleged to have been caused by the negligence of the company. On a trial of the case there wás a verdict for $10,000.00, but the trial court refused to enter a judgment on this verdict, and on motion of counsel for the railroad company dismissed the petition without prejudice, upon the ground that J. K. Hobbs, in whose name the action was brought as administrator, had never been…
