{¶ 1} Defendant-appellant Casildo Diaz appeals his conviction and sentencing for rape, kidnapping, and felonious assault. Defendant entered into a common-law marriage with the victim's mother when the victim was one-year-old. The victim and her brother lived with defendant for the remainder of their childhood and he raised them as their stepfather. When the victim was twelve-years-old, defendant took her into a van and raped her. He then warned her that if she told anyone, he would kill both her mother and himself.
