KOHN, Justice.

This action was filed by the plaintiff as the administrator of the estate of Enrique D'e La Cruz, and claimed the sum of $4,500, alleged to be due to the deceased’s estate under a policy of insurance between Carlos De La Cruz and the appellant, State Farm Mutual Automobile Insurance Company.

The case was submitted to the court on waiver of a jury trial by both the plaintiff and the defendant on the plaintiff’s amended complaint.
