I. INTRODUCTION

On the 13th day of October 1998, the above-styled matter came before the Court for consideration of the plaintiffs’ motion for summary judgment (Documents #10) and the defendants’ motion to dismiss “ehargel” and for summary judgment of “charges 2” and “charge 3” of the plaintiffs’ Complaint (Document # 18). The plaintiff appeared pro se, and the defendants appeared by their counsel of record. Both counsel presented oral arguments in support of their respective motions.
