HAWLEY, District Judge.

This action' was brought against Osea M. Welburn and sureties upon his official bond as collector of internal revenue for the First district of California. The condition of the bond is that:

“If the said Osea M. Welburn shall truly and .faithfully execute and discharge all the duties of the said office according to law, and shall justly *991and faithfully account for and pay over to the United States, in compliance with i.he orders and regulations of the secretary of tins treasury, all public moneys which may come into his hands or possession, and. if each and every deputy…
