Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: The Hyatt Regency Hotel (project) in Rochester was constructed on land owned by defendant County of Monroe Industrial Development Agency (COMIDA). Construction on the project began in the mid-1980s, but was discontinued before completion. In 1990 defendant CORH Associates, L.P.
