Appellee sued appellant in the Circuit Court of Bock Island county to recover damages for an injury sustained by him, as he alleges, resulting from the negligence of the servants of the railroad company. The case has been tried in the Circuit Court three times. The first trial resulted in a verdict for plaintiff which was set aside on the defendant’s motion. On the second trial plaintiff recovered a verdict-for $5000 upon which the court rendered judgment. Upon appeal to this court that judgment was reversed and the cause remanded. C., R. I. & P. Ry.
