MEMORANDUM OPINION
EMMET G. SULLIVAN, District Judge.
Pending before the Court is the Motion for Preliminary Injunction of Plaintiff Frederick Simms (“Simms”). Plaintiffs car was seized by the Metropolitan Police Department (“MPD”) on May 29, 2011, when he was accused of weapons violations. Plaintiff was acquitted of all charges in December 2011; nevertheless, the District of Columbia (“District”) continues to maintain possession of the car in the hope of eventually getting title to it by prevailing in civil forfeiture litigation. The forfeiture proceedings were not commenced until June 1, 2012…
