RUDDY, Acting Presiding Judge.

Marie Boulch and Thomas H. Boulch, her husband, brought this action against St. Elizabeth’s Academy, a corporation; John B. Gutmann Construction Company, Inc., a corporation; and Richard E. Harder doing business as Richard E. Harder Contracting Company.

In the first count of the petition Marie Boulch alleged that she fell on a sidewalk and that she was caused to slip and fall by reason of the muddy condition of the sidewalk, which condition said plaintiff alleged was due to the carelessness and negligence of defendants and each of them.
