OPINION

By WISEMAN, J:

This is an appeal on questions of law from the Common Pleas Court of Greene County, Ohio, which rendered judgment for the defendant-appellee, Permelia Stephens, in an action for declaratory judgment.

This action was instituted to determine who was entitled to the proceeds of two life insurance policies issued on the life of the decedent, Sylvan Ray Garver. On January 4, 1943, Garver purchased an insurance policy and a trust certificate (in the nature of an insurance policy) and named his then wife, Jeannette Marie Garver, as beneficiary, reserving the right to change the…
