Appellee was employed by appellant as a laborer in the construction of a sewer system in the city of Harrison. A sewer ditch was dug with a machine adapted to that purpose. The bottom of the ditch was level so the sewage would flow through the sewer pipes. The depth of the ditch varied according to the undulations of the surface of the earth. Appellee was working as a pipe-laying helper and engaged in work connected with the sealing of the joints laid at the bottom of the ditch, which was from six to nine feet deep at the place where appellee was employed at the time of the injury to…
