On this day came on to be considered Defendant/Counter-Claimant AluChem, Inc.’s (“AluChem”) first motion for summary judgment (D.E. 16) against Plaintiff/Counter-Defendant Sherwin Alumina L.P. (“Sherwin Alumina”). 1 For the rea sons set forth below, AluChem’s first motion for summary judgment is GRANTED in its entirety.
