OPINION

By WISEMAN, J.

This is an appeal on questions of law from the judgment of the Common Pleas Court of Franklin County.

The, plaintiff filed an action for a declaratory judgment requesting the Court to declare the rights of the parties arising out of a purported lease entered into between the defendant-company and plaintiff’s grantors. The defendant-company filed an answer and cross-petition in which it *254prayed for specific performance based upon an option to purchase which was contained in the lease.
