An information was filed against defendant and appellant in which he was accused as follows: In count one of the crime of sex perversion, a violation of section 288a of the Penal Code, it being alleged that defendant and appellant on May 13, 1946, participated in an act of copulating his male sexual organ with the mouth of one Joe Hernandez. In count two of the infamous crime against nature, committed on the same date upon the person of one Joe Hernandez; in counts three, four and five of prior convictions of felonies, one of arson and two of burglary.
