In my judgment the order granting a new trial should -be reversed. The case was tried to a jury; a verdict was returned for the defendant. On March 24,- 1921, judgment was rendered in favor of the defendant, -dismissing the cause of action. Thereafter a m-otion for a new trial was granted on the ground of insufficiency o-f the evidence.

T-he plaintiff could not recover without proof of the indorsement of the certificate of deposit. The four notes purporting to be signed by W. W. Ross and the indorsement on the certificate of deposit were all before the jury. They had the-opportunity to compare…
