*1245Appeal and cross appeal from an order of the Supreme Court, Monroe County (Thomas A. Stander, J.), entered January 31, 2006. The order denied plaintiffs motion for partial summary judgment on liability on the Labor Law § 240 (1) claim and denied defendant’s cross motion for summary judgment dismissing the complaint.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
