OPINION OF THE COURT

Memorandum.

The judgment appealed from and the order of the Appellate Division brought up for review should be affirmed, with costs.

Claimant was injured when he fell from the top of an unfinished abutment wall that rose some 15 feet above a road construction site. At the time of the accident, claimant was employed by a contractor that had been retained by the State to assist in the erection of a ramp.
