A jury convicted appellant of the felony offense of retaliation which appellant committed against a jailer while appellant was “an inmate in the institutional division of the Texas Department of Criminal Justice” serving a sentence for burglary of a habitation. The trial court assessed punishment for the retaliation offense, enhanced by two prior felony convictions, at confinement for 25 years.
