Appeal by defendant from a judgment of the Supreme Court, Nassau County, entered June 5, 1974, after a nonjury trial, which inter alia (1) granted plaintiff a separation on the ground of abandonment, alimony and counsel fees and (2) awarded plaintiff $32,375 to reimburse her for expenditures for necessaries from November 1, 1972 to May 16, 1974. Judgment modified, on the law and the facts, by striking therefrom the fourth decretal paragraph, which awarded the $32,375 to plaintiff, by substituting therefor a provision dismissing the second cause of action, which is for reimbursement as to…
