RIVES, Circuit Judge.

This action is for a conspiracy to interfere with civil rights, under 42' U.S. C.A. § 1985(3) , 1 or for the deprivation of such rights, under 42 U.S.C.A. § 1983, 2 or both; The appeal is from a judgment dismissing the complaint as failing tc state a claim upon which relief can be granted against any of the defendants.

The averments of the complaint, must be restated at some length. The defendant Brautigam was State’s Attorney of the Eleventh Judicial Circuit of Florida; the defendant Mills was a police officer, special investigator or deputy sheriff of Dade County,…
