I. Background

On April 19, 2001, Plaintiff Paul Mitchell (“Mitchell”) filed a civil rights action under Section 1983 of Title 42 of the United States Code against employees and officers of the New York State Department of Correctional Services (“DOCS”). Complaint (Dkt. No. 1). On February 3, 2003, Defendants filed a Motion for summary judgment. (Dkt. No. 20). On September 29, 2003, Magistrate Judge David R.
