{¶ 1} Deborah Ann Leisten appeals from the judgment of the Montgomery Count Court of Common Pleas, which denied her motion for intervention in lieu of conviction.
{¶ 2} On February 15, 2002, Leisten was indicted for three counts of forgery, in violation of R.C. 2913.31(A)(1), a fifth-degree felony. On March 26, 2003, the court found that Leisten had been granted diversion through the Montgomery County Prosecutor’s Office diversion program, and the case was stayed until Leisten had either successfully completed the program or was unsuccessfully terminated from the program.
