The public administrator has brought this action to recover damages for the death of Emma H. Jeutter, alleged to have been caused by the negligence of defendant.

*142The complaint alleges that the deceased entered the defendant’s premises with the intention of transacting business with one of the tenants on the third floor and, as she entered the elevator, notice was given to the operator to stop the car at that floor. The car stopped but, while the deceased was alighting, it started upward and she was struck on the head by the upper casing óf the shaft door, being violently thrown to the floor.…
