Judgment, Supreme Court, New York County (Edward J. McLaughlin, J), rendered February 15, 2011, convicting defendant, after a jury trial, of criminal sale of a controlled substance in the third degree, and sentencing him to a term of two years, unanimously affirmed.

The court properly exercised its discretion in denying defendant’s belated mistrial motion, made after a detective revealed defendant’s involvement in an uncharged crime. The court gave curative instructions that were sufficient to prevent any prejudice (see People v Santiago, 52 NY2d 865 [1981]), and which the jury is presumed to…
