RTNEK, District Judge.
This case is before the court upon a motion to dissolve an attachment. The defendants were co-partners doing business under the Ann name of S. E. Mills & Co., and carrying on a general mercantile business, in Sheridan county, this state, at the towns of Dayton, Parkman, and Slack. On the 14th of January, 1898, they made an assignment of the firm property for the benefit of tlie creditors of the firm, but made no assignment of the property of the individual members of the firm.
