In 2009, as part of an adversary proceeding in bankruptcy court, Plaintiff American Federated Title Corporation (“AFTC”) sued four limited liability companies for breach of contract and unpaid rent. A year later, AFTC settled those claims for a total of $7.5 million. The limited liability companies then failed to satisfy any portion of the judgment, and in 2013, AFTC commenced this special proceeding under Federal Rule of Civil Procedure 69(a) and New York CPLR § 5225(b), a state statute that permits judgment creditors to recover funds improperly…
