An instrument in writing, purporting to be the last will and testament of the deceased, was presented to the county court by his widow, Martha J. Cole, for probate. It was executed and attested in due form, and, by its terms, the alleged testator devised and bequeathed his whole estate to his said widow. Probate of the instrument was contested by the sons of the deceased, Rinaldo W. and Elliott G. Cole, who appealed to the circuit court from the order of the county court admitting the instrument to probate as the last will and testament of their deceased father. The trial in the circuit…
