DECISION AND ORDER

The matter before the Court is the chapter 13 Trustee’s “Motion to Dismiss without Hearing Pursuant to Local Rule 1017-2 for Maintaining Two Petitions Contemporaneously,” filed on January 6, 2009. The debtor, Mark Gregory Brown, filed the above-captioned chapter 13 proceeding on December 16, 2008 (herein the “Second Case”) pro se.
