P. D. Hogg, plaintiff in error, being the owner of a tract of land, on February 2, 1908, executed and delivered to W. H. & D. W. Powers a lease whereby he granted, demised, leased, and let to said parties said land for the sole and only purpose of mining and operating for oil and gas.
