MEMORANDUM OPINION AND ORDER

CASTILLO, District Judge.

Technical Loss Services, Inc. (“TLS”) sues American Telephone and Telegraph Company (“AT & T”) on behalf of itself and all other persons with AT & T telephone service within the Chicago area, alleging breach of contract and consumer fraud. Specifically, TLS claims that AT & T contracted to provide customers with local telephone service when it knew that it did not have the ability to process incoming and outgoing telephone calls.
