Motion by the defendant, The Glens Falls Insurance Company, for a new trial on- a case containing exceptions, ordered to be heard at the General Term in the first instance upon the verdict of a jury rendered after a trial at the Cayuga Circuit on the 16th day of May, 1895. The jury rendered a verdict in favor of the plaintiff for $409.

Follett, J.:
January 25, 1895, this action was begun to recover the value of a dwelling house destroyed by fire which, it is alleged, the defendant insured.
