FUNDERBURK, Justice.

Alexander Zogheib, owner of a vacant lot in San Antonio, made application to the city commissioners for a permit to erect thereon a drive-in filling station. The application was in due form, and accompanied by approved plans and specifications. There was no covenant running with the land which prohibited the operation of a filling station thereon, and the lot was located in an area in which such filling stations were not prohibited.
