— On the 3rd day of September, 1906, the appellee filed his bill in chancery against the appellant in the circuit court for Taylor county, alleging therein, in substance, that he was the owner in fee and in the possession of certain described lands, the source of the complainant’s title and the different links in the chain thereof being particularly set forth; that the executors of the last will and testament of Neal Hendry, deceased, undertook to sell the lands in question to W. B. Stephens by a deed of conveyance dated the 31st day of December, 1895, which was not recorded until the 3rd day…
