PRELIMINARY STATEMENT

Before the court is defendants’ motion for summary judgment. The motion is based, inter alia, on the defenses of res judicata and/or collateral estoppel, statute of limitations, and failure to plead necessary facts, as well as the absence of genuine issues of material fact, thus foreclosing liability, with respect to several of plaintiff’s theories of recovery.
