The present application to compel substituted testamentary trustees, appointed by the Probate Court of Norfolk county, Mass., to distribute the remainder of a trust in their hands pursuant to a direction contained in the will of a resident donee of a power of appointment thereof, presents a number of interesting and novel questions of jurisdiction, the full import of which appear to be imperfectly appreciated even by the parties themselves.
