Hirsch v. Bucki

Separate appeals, each raising a different question, by the defendant Hattie E. Weisz and the defendants Charles S. Hirsch and others, individually, from a judgment of the Supreme Court in favor of the defendant Louise S. Bucki, entered in the office of the clerk of the county of Hew York on the 1st day of December, 1913, upon the decision of the court after a trial at the Hew York Special Term. The action was brought for the construction of a will.

Clarke, J.:
Frederica Bucki, the mother of Charles Lloyd Bucki, executed her last will and testament on October 26, 1910. By the *6616th clause thereof she gave all the rest, residue and remainder of her property, both real and personal, to her executors and trustees in trust for the uses and purposes following:(a) To invest the same and keep the same invested, etc., and to pay one equal third part of the net income thereof to the use of her niece, Amalie Reif, “during the life of my son, Charles Lloyd Bucki, provided that my said niece shall remain unmarried during that time. * * *
