Petitioner herein is the vendee under a contract, conditioned upon the property being usable for apartment houses, covering a five-acre parcel of land which fronts 350 feet on North Main Street, Freeport, and extends westerly some 680 feet. By this article 78 proceeding petitioner seeks to review the affirmance by the Board of Zoning Appeals of the Building Inspector’s denial of a building permit, and the board’s denial of petitioner’s application for a variance on the ground of practical difficulty and unnecessary hardship.
