This case was one of several arising from the crash of a private aircraft. Trial occurred in phases. By this court’s prior Order, claims by Plaintiff Dianne H. Dorton, as personal representative of the Estate of Randall Alexander Dorton (“Dorton”), were tried to a jury in April and May 2009, and claims by certain of the Third-Party Plaintiffs against the United States for alleged air traffic controller fault were tried to the court from July 7 through 24, 2009. 1 Both the jury and this court found no…
